These Terms & Conditions ("Terms") govern your access to and use of the GoToEat restaurant management platform, including our point-of-sale system, online ordering, dashboards, and related websites and services (collectively, the "Services") provided by Histone Solutions Pvt Limited, operator of GoToEat ("GoToEat", "we", "us", or "our"). By creating an account or using the Services, you agree to be bound by these Terms.
1. Eligibility & Accounts
You must be at least 18 years old and able to enter into a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. Plans, Trials & Billing
- New restaurants start with a free trial of 30 days. When it ends you may pay for a plan or continue on the Free plan.
- Paid plans are billed in advance for the term you choose (monthly, six-monthly or annual). Pay Per Order commission is invoiced monthly in arrears on completed online and QR orders. Prices are shown in your local currency on our pricing page and on each invoice, and include or exclude tax as stated there.
- Invoices are payable by the methods shown on the invoice, such as card, bank transfer, Raast, JazzCash or Easypaisa. Card and wallet payments are processed by licensed third-party payment service providers; we do not store full card numbers.
- If a renewal invoice is not paid, your restaurant moves to the Free plan after the reminder period shown on the invoice.
- Fees are non-refundable except as set out in our Cancellation & Refund Policy.
- We may change our fees with reasonable advance notice; changes take effect at your next renewal.
3. Acceptable Use
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorized access to the Services or other accounts.
- Interfere with or disrupt the integrity or performance of the Services.
- Reverse engineer, copy, or resell any part of the Services except as permitted by law.
4. Your Content
You retain ownership of the content you upload, including menus, products, and customer data. You grant us a limited license to host and process that content solely to provide the Services. You are responsible for ensuring you have the rights to the content you provide and that it complies with applicable laws.
5. Restaurants and Their Customers
GoToEat is a multi-tenant platform that hosts independent restaurant businesses. These Terms govern your relationship with GoToEat as the platform provider. When a customer orders through a restaurant's website, QR menu or app powered by GoToEat, the contract for that order is between the customer and the restaurant. The restaurant sets its menu and prices, prepares and delivers the order, and is responsible for its food, its own policies and its customer relationships. Cancellations and refunds of orders are handled as described in Part B of our Cancellation & Refund Policy.
Online payments for orders
Where a restaurant accepts online payment, payments are processed by a licensed third-party payment service provider and are subject to its terms. By paying online you authorise the charge for the order total shown at checkout. Restaurants using online payments must honour the refunds described in our Cancellation & Refund Policy and must not use the Services to take payment for goods or services other than their own.
6. Intellectual Property
The Services, including all software, design, and trademarks, are owned by Histone Solutions Pvt Limited (see our Ownership Statement) and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except for the limited right to use the Services.
7. Termination
You may cancel your account at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a manner that may cause harm. Upon termination, your right to use the Services ceases immediately.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Histone Solutions Pvt Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms or the Services are subject to the the courts at Rawalpindi, Pakistan.
